NEW STUDY DISCUSSES HOW THE DIGITAL ECA AND THE SUPREME COURT’S RULING ON THE MARCO CIVIL DA INTERNET REDEFINE CONTENT MODERATION ON PLATFORMS

The new LabSul study analyzes the issue of content moderation from the perspective of two recent milestones: the Brazilian Supreme Federal Court (STF) ruling on Article 19 of the Marco Civil da Internet (MCI) and the Digital ECA — Law No. 15,211/2025.


The policy paper examines how this new normative framework interacts with the STF’s recent decision in Theme 987, which reinterpreted Article 19 of the Marco Civil da Internet (Law No. 12,965/2014), redefining the model of platform liability for the circulation of illegal content.


Issues of freedom of expression and digital protection are critically analyzed. Content moderation is undergoing redefinition, and our researchers have delved deeply into the topic in an effort to contribute to this important debate.
