NEW PUBLICATION ANALYZES GAPS IN BRAZILIAN LEGISLATION ON HATE SPEECH ON DIGITAL PLATFORMS

The article “Hate speech on digital platforms: Brazilian context, legislative vacuum, and analysis of European regulation”, authored by Gustavo Silveira Borges and Felipe Pinheiro Prestes, both affiliated with the University of the Far South of Santa Catarina (UNESC) in Criciúma (SC), was published in the Journal of Cultural Rights (URI).
The study seeks to answer a central question: Does Brazil have an effective regulatory model to address hate speech in the digital environment?
Using an exploratory and descriptive documentary methodology, combined with the hypothetical-deductive method, the authors analyze the challenges faced by the Brazilian legal system in responding to the growing spread of hate speech on digital platforms.
The article first presents the multiple concepts of hate speech and then examines European regulation, highlighting how it can serve as a reference for Brazil. Finally, it addresses current national legislation, bills pending in the National Congress, and the recent ruling on Article 19 of the Brazilian Civil Rights Framework for the Internet by the Federal Supreme Court (STF).
The conclusions indicate that Brazil still has significant gaps in its legislation for dealing with this type of content, particularly the absence of a clear and applicable definition of hate speech. The authors argue for the need for regulatory modernization, drawing inspiration from models such as the European one, to ensure a more effective and up-to-date response to the challenges of the digital environment.
